WOMA Pty Ltd operating via the web site - serpentdreaming.com.au.
The following terms and conditions or trade apply to the art bought and sold through this company. 2010.
CONDITONS OF SALE
In agreeing to purchase art from Woma Pty Ltd (herein called Woma) the customer acknowledges that they are accepting the terms and conditions of trade as displayed in this web site (WWW.serpentdreaming.com.au), notice of which is advised in all correspondence from Woma related to any trade or purchase of art.
AVAILABILITY OF ART
The art that is displayed on the web site WWW.serpentdreaming.com.au is available for purchase unless otherwise stated either in the web site or elsewhere. All art is available on a first come first serve basis. Where art is to be ‘on-hold’ for someone seeking to purchase it, a 10% up front non refundable deposit is to be given by the purchaser to Woma.
All art is supplied with a certificate of authenticity (CofA) to give the purchaser assurance that it has been painted by the artist identified as having painted it. Some art comes with working photos of the artist actually painting the work.
PURCHASE
Enquiries are to be made via email to ccherps@iinet.net.au or by phone to Gavin Bedford on 0413080045.
Confirmation of an order made for an art piece is to be via an email from ccherps@iinet.net.au or some other applicable email address, via SMS to the purchasers mobile phone to a Fax.
Within 24hours of confirmation of the order for an art work, Woma will issue the purchaser an invoice for the art detailing the price of the art plus freight and other charges such as GST where applicable.
PAYMENT
On receipt of an order Woma will issue an invoice to the purchaser that will itemise the cost of the art inclusive of GST, plus freight and packaging to the destination nominated by the purchaser.
Payment in full will be required prior to shipment unless otherwise acknowledged in writing by Woma. Payment is to be made by cheque, money order, direct deposit or cash.
When the full amount has been received the purchaser will receive notice of delivery and all details via email or sms. Woma reserves the right to cancel the order or apply further conditions and charges should payment not be forthcoming by the advised due date specified on the invoice. Art work subject to cancellation of sale will be re-advertised on the web site.
FREIGHT AND SHIPMENT OF ART
Art will be consigned to one of the major couriers from Darwin. This would mean Australian Air Express, Toll, Australia Post or TNT would be consigned the freight and the purchaser would be given the consignment note and approximate delivery date and time where possible. If the purchaser resides in Darwin or can make other arrangements regarding pickup then the cost will be reduced by the total freight amount.
Art will be packaged in tubes and sent with destination instructions on the tube where possible. Art that is in the form of paper or some other form will be packaged appropriately for the type of art. Some art will be sold with frame included if it will travel like that and if the purchaser wants the frame.
The cost of freight will be separately itemized on the invoice acknowledging conditions of sale.
COLLECTION OF ART
The art work consigned to the courier will need to be signed for on delivery with proof of identity needed for acceptance. The art will be insured in transit but becomes the purchaser’s property on signing for the art work. Where the purchaser is not at the point of delivery the courier will leave a note and return the package to the despot for collection there.
WEB SITE INFORMATION
While every effort is taken to ensure the information on the Serpent dreaming web site is up to date and factual, the interpretation and acceptance of what is written is the responsibility of the customer or others who use the web site.
CUSTOMER SATISFACTION
If the purchaser is not satisfied with the art work on acceptance from the courier they must notify in writing Woma Pty Ltd stating the reason for the dis-satisfaction. A change of ones mind is not a legitimate answer. At the discretion of Woma Pty Ltd the purchase price of the art may be refunded minus the costs involved with the return of the art and any sundry costs involved.
CANCELLATION
Woma Pty Ltd holds the right to cancel any order prior to shipment. Woma shall not be liable for any loss or damage arising from a cancellation.
VISITATION
Woma via serpentdreaming is a wholly web based business and does not have a shop front or suitable mechanism for people in Darwin to view the art
CHANGES TO ‘TERMS AND CONDITIONS of TRADE’
The TERMS and CONDITONS of TRADE are subject to review. Customers please reacquaint your selves with these Terms and Conditions of Trade as considered necessary. The Terms and Conditions displayed on the serpentdreaming web site are deemed to be the current version.
